Terms and Conditions
General Provisions
The service provider is MERKANTIL GEO d.o.o., education, consulting and translation,
Knežak 3, 6253 Knežak, Slovenia (hereinafter: the Provider).
The client is any legal or natural person who has ordered the Provider’s services via the website
or in any other written form (hereinafter: the Client).
General Terms
The services are governed by these Terms and Conditions of business and service use of
MERKANTIL GEO d.o.o. (hereinafter: the Terms and Conditions), which are binding on all parties.
These Terms and Conditions, together with a completed service order via the website
sloveniahomeland.com, constitute a contract between the Provider and the Client.
If a separate written agreement is concluded, its provisions shall prevail over these Terms and Conditions.
For all matters not regulated herein, the provisions of the Obligations Code, the Electronic Commerce
and Electronic Signature Act, and the Consumer Protection Act shall apply accordingly.
The Provider and the Client undertake to act with due diligence and in good faith.
Any disputes shall be resolved amicably. If this is not possible, disputes shall be settled by the
competent court in Ljubljana in accordance with Slovenian law.
The Provider reserves the right to amend these Terms and Conditions at any time and without prior notice
in order to ensure compliance with applicable legislation and internal policies.
Changes become effective upon publication on the website. If the Client does not object within
15 days of publication, the changes shall be deemed accepted.
Prices and Commercial Terms
All prices on the Provider’s website are stated in euros (€) and include VAT, unless otherwise specified.
If a specific service is not listed on the website, the Client may request it in writing or obtain information
at the Provider’s registered office.
The Client undertakes to pay for services within 8 days of invoice issuance.
In the event of non-payment after 20 days, the Provider has the right, following prior notice,
to immediately suspend all services.
In such case, the Provider shall not be liable for any actual business damage incurred by the Client.
The Client also undertakes to reimburse any costs related to the reactivation of services.
By using the services of the website sloveniahomeland.com, you agree that all services are used
at your own risk. Services are provided on an “as available” basis.
The Provider does not guarantee that the services will fully meet your requirements or that they will be available
without interruption, securely, or without errors. The Provider also does not guarantee the accuracy or reliability
of information obtained through the services, nor that software defects will be corrected immediately.
You acknowledge that any data or files downloaded or otherwise obtained through the use of the services are obtained
at your own risk, and you are solely responsible for any resulting data loss or damage.
Duration and Termination of the Contract
Any order submitted by the Client to the Provider in written or electronic form shall be considered a valid order.
Payment of an advance based on the offer constitutes confirmation of the order and marks the beginning of the execution period.
If the advance payment is made after the expiration of the offer validity period, the Provider reserves the right
to modify the delivery deadline.
Either party may terminate the contract at any time and without notice by written notification to the other party
if either party commits a serious breach of the contract.
The Client undertakes to settle all obligations arising from the contract up to the date of termination.
In the case of advance payment, the Client shall not be entitled to a refund of amounts paid in advance
for services in respect of which costs have already been incurred by the Provider.
Confidentiality and Data Protection
The Provider and the Client undertake to treat as confidential all data obtained during their business cooperation
throughout the entire duration of the cooperation and for at least three (3) years after termination
of the contractual relationship.
The Provider undertakes not to disclose the Client’s data to third parties except with the Client’s express written consent.
Technical Support
Customer support is available on working days between 08:00 and 16:00, generally via email at
info@sloveniahomeland.com.
The Provider is obliged to consider only support requests sent to
info@sloveniahomeland.com from the Client’s contact email address
specified when ordering the services. The Provider is not obliged to consider requests received via telephone
or other communication channels.
By ordering services, the Client authorizes the Provider to send information, notices, and online survey questionnaires
directly related to the services of MERKANTIL GEO d.o.o. to the Client’s email address for the duration
of the contractual relationship.
The Client may refuse to receive such communications at any time by submitting a written request to the Provider.
Rights and Obligations of the Service Provider
Under no circumstances shall the Provider be liable for any direct or indirect loss of income or any damage arising
from improper functioning of the Provider’s services or devices.
Under no circumstances shall the Provider be liable for any direct or indirect loss of income or any damage arising
from the loss or theft of the Client’s data or other parameters necessary for the use of the Provider’s services.
In the event of any action by the Client or user that is contrary to applicable Slovenian or international law,
or in the case of a serious breach of these Terms and Conditions, the Provider has the right to immediately suspend
services without prior notice, regardless of any business damage the Client may suffer as a result.
The Provider may require the Client to remove information, services, or content, or may otherwise restrict or prevent
access to them, if they could be considered objectionable or harmful to the Provider or contrary to these Terms and Conditions
and applicable Slovenian law.
Exclusion of Liability of the Provider
The Provider is not responsible for the Client’s files stored on servers and shall under no circumstances be liable
for any direct or indirect loss of revenue, profit, or any damage arising from network or server malfunction,
or from the loss, corruption, or theft of the Client’s data.
Rights and Obligations of the Client
The Client must submit any complaint regarding an invoice within a maximum of 8 days from receipt.
Protection of Personal Data
The Client agrees that the Provider may collect and process personal data for the purposes of its business operations.
The Provider shall ensure uninterrupted access to and management of the Client’s data via the user pages.
The Provider shall retain personal data and business-related data for the period prescribed by law.
Cancellation of Work
The Client has the right to cancel services, but acknowledges that the Provider has reserved the appropriate resources
for project execution, which cannot be reassigned at short notice. Therefore, in certain cases, the Provider is entitled
to appropriate compensation.
Cancellation made 7 or more days before execution does not entail compensation costs.
In all other cases, compensation shall be subject to agreement between the Provider and the Client.
If the Client cancels the project after it has already commenced, the Provider reserves the right to charge
for the work actually performed.
Cancellation shall only be valid if submitted in writing by the responsible person who ordered the project.
