Description
Under an exchange agreement, each party undertakes to transfer to the other party the exchanged asset (real estate), in such a way that the receiving party acquires the right of disposal or ownership rights over the property.
An exchange agreement creates for each party the same rights and obligations as those arising for a seller under a sale agreement.
This type of agreement is suitable for the exchange of all types of real estate (apartments, agricultural land, meadows, forests, commercial premises, etc.).
The agreement we prepare includes a Land Registry authorization clause, on the basis of which both parties are registered in the Land Register as the new owners of the respective properties.
In cases where the transaction is conducted between spouses (or cohabiting partners), the agreement must be executed in the form of a notarial deed.
For the transfer of ownership, it is also necessary to obtain a land use certificate from the municipality where the property is located. This certificate is not required if the subject of the agreement is an individual (separate) unit within a building.
