Description
This document is used to create a power of attorney, whereby one person (the principal) authorizes another person (the agent) to act on their behalf in specific matters.
The document is primarily intended for third parties, enabling them to verify the existence and scope of the authorization, and to determine in which cases the person acting as an agent is duly authorized to perform actions in the name and on behalf of the principal.
In certain cases, a written form of authorization is a requirement for the validity of the power of attorney, while in other cases it is strongly recommended as evidence of the type and scope of the authorization.
Certain legal transactions must be executed in the form of a notarial deed (a list of such transactions can be found on the website of the Notarial Chamber under the section “What does a notary do?”). If the power of attorney is granted for such a transaction, it must also be executed in the form of a notarial deed.
